Origin and location of the rules

Decree 472 of 2015 regulated criteria for determining fines, procedural safeguards and measures responding to health and safety breaches in Colombia. Its provisions were incorporated into Chapter 11 of the occupational risks title of Decree 1072 of 2015. Current consultation should review that compilation and its changes, rather than treating the original decree as a standalone regulation.

Penalties require reasons

The criteria for determining penalties allow circumstances of a breach to be considered, such as recurrence, diligence, obstruction or harm and danger created, where applicable. The authority must justify its decision within the procedure. No single amount can be inferred from a brief description of a finding, and a fine cannot be calculated without checking the rules, facts and applicable financial provisions.

Due process

Administrative action must respect powers and safeguards for defence and challenge. The organisation needs to retain authentic information and respond through the prescribed channels, without retrospectively fabricating records. Regulatory compliance in OSH is demonstrated through consistent actions and evidence, rather than solely through a statement that a management system exists.

Improvement plans and protection

The chapter provides for plans to correct identified situations, with activities, owners and deadlines. Having a plan does not necessarily prevent penalty proceedings from continuing. It also distinguishes measures such as stopping or prohibiting tasks when the specified conditions arise. Correcting the risk and resolving the administrative case are related but different processes.

Example of an organised response

In a hypothetical example, an inspection identifies a preventive measure that has not been implemented. The company immediately protects people according to the risk, assigns responsibility and documents the correction. In parallel, it responds to the administrative procedure and preserves original evidence. A completion date written on a sheet does not replace physical verification or independently determine the penalty outcome.

What to review before deciding

The authority, breached provision, date of the events, notified decisions and response deadlines must be identified. Amounts and appeals require legal review of the case and the applicable framework. This entry explains the purpose of the rules; it does not provide a penalty calculator or interpret the potential liability of an individual company.
