What it regulates

Decree 522-06, of 17 October 2006, establishes the Dominican Republic’s Occupational Safety and Health Regulations. It organises preventive obligations and is supplemented by technical provisions, including Resolution 04-2007. Its interpretation should distinguish the regulatory framework, applicable technical requirements and the labour authority’s administrative procedures.

Principles of preventive action

Article 7 places avoiding risks at source, planning prevention and adapting work to the person among the priorities. It also provides for substituting hazardous elements and prioritising collective over individual protection. This guides decisions on processes and installations: providing personal protection does not alone explain why a controllable hazard has not been eliminated or reduced.

Programmes and changes in activity

The health and safety programme must match the company’s risks. The regulations address its review when products, machinery or working methods are introduced, together with the necessary assessment, information and training. Connecting these actions with OSH management of change avoids retaining a programme that describes conditions that no longer exist.

Training and joint committees

Training should relate to the job and preventive measures, with records enabling completion to be checked. Joint committees provide a space for participation and follow-up. IDOPPRIL offers advice on their establishment. Their existence neither replaces employer responsibility nor itself demonstrates that people know how to respond to the risks of their task.

Companies sharing a workplace

When workers from several companies operate together, the regulations provide for coordination and exchange of preventive information. For example, contracted maintenance inside an installation requires communication about conflicting activities, site conditions and emergencies. Each company needs to know its responsibilities, who authorises the activity and how incidents are communicated, rather than limiting coordination to exchanging general documents.

Reviewing application

A useful review links risks with controls, owners, training records and checks on site. Official sources should be consulted to verify applicable amendments and procedures, particularly before reusing old forms. This entry explains the organisational framework; it does not turn technical values from a historical edition into universal limits or replace specialist assessment of each exposure.
