What Law 618 regulates

The General Law on Occupational Hygiene and Safety, approved in Nicaragua in 2007, brings together preventive provisions for industrial, agricultural, commercial, construction and service activities, among others. It includes employer and worker obligations, preventive organisation and physical requirements. It should be consulted alongside its implementing regulations, approved by Decree 96-2007, and provisions applicable to the activity.

Diagnosis and planning

Article 18 provides for an initial diagnosis, a specific risk map and a plan for prevention and promotion of healthy work. Changes in conditions or processes may require updates. Preventive planning should connect identified issues with measures, resources and owners, preventing the map from becoming a merely decorative drawing unrelated to workplace decisions.

The joint commission

The Joint Occupational Hygiene and Safety Commission is a body for equal participation by employer and worker representatives. The law provides for its organisation by workplace and regulates representation and duties. Its activity enables issues to be addressed and actions monitored; establishing it neither removes employer responsibility nor replaces the technical intervention an assessment may require.

Preventive training and information should relate to the diagnosis and risk map. This allows the needs of an administrative role to be distinguished from those of maintenance or substance handling. A training record is more useful when it identifies participants, task, content and assessment of learning, rather than only the course title and a signature list.

Example in a multi-site company

A company adds a second installation with a different process. Reusing the first site’s documentation unchanged would omit hazards specific to the new workplace. Analysis identifies differences, organises the corresponding participation and defines specific measures and training. Subsequent follow-up checks whether observed conditions match the assessment and whether outstanding actions have been closed.

Regulatory version and evidence

The original 2007 reference and the consolidated text in the labour law digest published in 2020 should be distinguished. A bibliographic record’s date does not turn an older regulation into a new law. Compliance review checks the text, implementing regulations and applicable official procedures; diagnosis, minutes, training and controls should allow preventive activity to be verified, rather than just the existence of files.
