What NR-3 regulates

Brazilian NR-3 develops embargo and interdição measures for conditions capable of causing serious injury or illness. These are neither fines nor seizure of assets. They are decisions intended to stop exposure to a hazard requiring immediate intervention. Their interpretation belongs to the Brazilian labour-inspection framework and does not transfer automatically to other countries.

Embargo and interdição are different

Embargo means stopping construction work in whole or in part. Interdição may affect an activity, establishment, department, machine or equipment. The regulation seeks to define the affected unit according to the identified situation. For example, a dangerous condition confined to one piece of equipment does not, by itself, mean the entire enterprise must close. The decision depends on the assessment and its actual implications.

How risk is analysed

The text relates the possible consequence to probability and compares the observed situation with a controlled reference situation. Excess risk is derived from that comparison. Identifying a missing document is not enough: the exposure capable of causing harm must be examined. Nor should the enterprise replace the inspector’s assessment with a scoring system designed to artificially lower the result.

Responding to a stoppage

An orderly preventive response identifies the scope of the measure, prevents others from entering the affected area and preserves information about the conditions found. It then defines the technical correction and evidence that will demonstrate its effectiveness. Removing tape or making an improvised repair does not establish that the hazard has disappeared. The applicable procedure and conditions for restarting must be respected.

Application example

In a hypothetical excavation with a collapse risk, recording a safety talk does not replace a stability study or necessary protective measures. The site manager would need to resolve the physical condition, check adjoining areas and coordinate affected contractors. This example does not prescribe an engineering solution: it shows why evidence must address the risk that prompted the intervention.

Connection with preventive management

Closing an issue should not be limited to the inspected location. It is useful to check whether the same condition exists on other work fronts, how the work was authorised and which controls failed. The general concept of serious and imminent risk helps explain the urgency, but NR-3 provides criteria specific to Brazil. Concrete decisions require consultation of the official text and competent authority.
