Occupational risk insurer (ARL, Colombia)

A workers’ compensation administrator, or ARL, is an entity of the Colombian system that manages insurance against occupational risks and performs functions of prevention, advice and provision of benefits.

In short

The ARL (Occupational risk insurer) participates in the prevention and coverage of workplace accidents and illnesses. Affiliation and advisory services do not replace the employer’s duty to identify risks, implement controls, and maintain the Occupational Health and Safety Management System (SG-SST).

What is an ARL?

Occupational risk administrators are part of Colombia’s General System of Occupational Risks. Their activities combine insurance, benefits management, and health promotion and prevention functions. They are related to occupational contingencies, but their name, rules, and powers are specific to the Colombian system and are not automatically equivalent to similar entities in other countries.

The ARL (Occupational risk insurer) is neither the employer nor the inspection authority. It should also not be confused with the EPS (Health Promoting Entity), whose function is health insurance within its scope. Understanding this division of responsibilities allows for the correct handling of inquiries, reports, and requests, without attributing all decisions related to health, work, and social protection to a single entity.

Membership and coverage

Registration must be carried out according to the type of employment and applicable rules. For salaried employees, the employer has specific registration and contribution obligations. Contractors and independent contractors have different circumstances, so a single procedure should not be applied without reviewing the activity, contract, risk classification, and liability of the participants.

The organization needs to verify that membership and updates reflect the actual working conditions. Maintaining outdated records is insufficient if relevant information has changed. It must also inform individuals about the organization and its support channels so they can respond to emergencies without relying on impromptu searches.

Support for prevention

Occupational risk insurers (ARLs) provide advisory, assistance, and preventive services as stipulated by regulations. Resolution 0312 of 2019 details support for specific groups of companies, including hazard identification, controls, training, and technical assistance. The intensity and content of these services must be tailored to the applicable needs and obligations, not simply a generic catalog of courses.

To leverage this support, it’s advisable to present clear information about processes, priority risks, and pending actions. A visit can be more effective if the company specifies the problem it needs to solve and arranges access to the relevant departments and personnel. It should then translate recommendations into decisions, assign responsibilities, and implement follow-up within its management system.

Obligations that the employer retains

Decree 1072 of 2015 places obligations for the protection, organization, and operation of the Occupational Health and Safety Management System (SG-SST) on the employer. Having an Occupational risk insurer (ARL) does not eliminate the need to assess risks, allocate resources, implement controls, and verify results. External consulting services also do not automatically transfer the responsibility for implementing the measures to the party issuing the recommendation.

It is advisable to differentiate the responsibilities of the Workers’ Compensation Insurance Company (ARL) and the company in each joint activity. If a machine modification is proposed, for example, the organization must manage the analysis, purchase, installation, and maintenance as appropriate. Recording that the ARL visited the site does not prove that these actions actually took place or that the hazard is under control.

Reports and benefits

Work-related accidents and illnesses must be reported using the appropriate procedures, including FURAT and FUREL reporting forms (Colombia) when applicable. The report must be timely, complete, and consistent with the known facts. It does not replace preventive investigations nor does it, on its own, determine the origin of an incident; these matters have separate functions and procedures.

The system provides for welfare and financial benefits in the legally established cases. Their recognition depends on the applicable framework and the competent authorities. In a specific case, the company must provide the relevant information, and individuals must have access to guidance channels, ensuring that internal procedures do not delay necessary urgent care.

Practical example

In a hypothetical scenario, a company requests support from its Workers’ Compensation Insurance Company (ARL) because it has detected problems during loading operations. Before the visit, it gathers observations, tasks, incidents, and existing safety measures. The joint review identifies organizational and control needs that are incorporated into the annual work plan, with agreed-upon company representatives and support.

During the monitoring process, the company verifies implementation and shares relevant results with the Workers’ Compensation Administrator (ARL). If an incident occurs, it activates the corresponding response and reporting procedure, without assuming that the prior visit replaces these obligations. Preventive support is thus integrated into ongoing management and is not simply a matter of filing participation certificates.

Coordination and information management

The relationship with the Workers’ Compensation Insurance Company (ARL) requires sufficient information and protection of personal data. Clinical documents and other sensitive data must be circulated through authorized channels and limited to relevant purposes. A report for preventive management does not need to indiscriminately disclose individual diagnoses to all managers or representatives of the organization.

It is also advisable to maintain a record of requests, responses, commitments, and follow-up dates. This traceability allows for the identification of unresolved issues and the preparation of system reviews. Coordination should include the areas capable of acting on each risk, to prevent all communication from being concentrated in a single person without the resources to implement the recommendations.

Common mistakes

Among the most common mistakes are thinking that affiliation equates to full compliance, expecting the ARL (Occupational risk insurer) to design and implement all prevention measures, or using training as the sole response to any risk. It is also problematic to report incomplete data, be unaware of available support channels, and fail to review affiliation updates when relevant conditions change.

The Workers’ Compensation Administrator (ARL) is an important player in the system, but prevention requires coordinated work. The company must maintain control over its processes and decisions, workers must participate, and the relevant entities must fulfill their responsibilities. An effective relationship is evident when the support provided contributes to verifiable measures and an organized approach to workplace incidents.
